IDAHO PROPERTY MANAGEMENT AGREEMENT
THIS PROPERTY MANAGEMENT AGREEMENT ("Agreement") is made effective as of [Date], by and between:

The Owner and the Agent shall be collectively referred to as the “Parties”.
APPOINTMENT OF AGENT
The Owner hereby appoints the Agent with the exclusive right to rent, lease, operate, and manage the property or properties listed in Exhibit A attached hereto (the "Property").
TERM
The term of this Agreement shall commence on [Date] and shall continue for a period of 12 months, ending on [Date] ("Term"). Upon expiration of the initial Term, this Agreement shall continue on a month-to-month basis unless either Party provides the other with thirty (30) days’ written notice of termination.
OWNER’S RESPONSIBILITIES
Expenses and Mortgages: The Owner agrees to keep all mortgages, taxes, and insurance up to date.
Insurance: Maintain liability and property damage insurance on the Property and name the Agent as an additional insured.
Home Warranty: Maintain home warranty insurance on the Property and name the Agent as an additional insured.
Records and Documentation: Provide the Agent with all necessary documents and records related to the ownership, maintenance, and operations of the Property.
AUTHORITY AND DUTIES OF AGENT

As your dedicated Property Management Agent, we commit to leveraging our industry-leading expertise to not only maintain but actively enhance both the operational efficiency and market value of your property. We aim to deliver measurable benefits through strategic management tailored to your unique property needs.
Duties of the Agent
The Agent is authorized and entrusted to manage the property effectively with the following responsibilities:
Leasing and Renting
Strategic Leasing: Initiate and conduct negotiations of rental agreements to secure optimal terms that protect and benefit the Owner. Provide detailed market analysis reports bi-annually to inform and support rental adjustments and marketing strategies.
Maximized Occupancy: Utilize proven marketing techniques and thorough tenant screenings to decrease vacancies and enhance tenant quality.
Collection of Rents
Prompt and Efficient Collection: Implement state-of-the-art systems and protocols for the timely collection of rents and other dues, optimizing cash flow and financial reporting to the Owner on a monthly basis.
Compliance
Regulatory Adherence: Ensure all property operations comply with homeowners association, and local, state, and federal laws to avoid any legal issues. Regularly update the Owner on new regulations and compliance status.
Maintenance and Repairs
Proactive Maintenance: Manage and supervise all necessary maintenance and repairs, prioritizing preventative measures to reduce emergency incidents. Provide quarterly maintenance reports and immediate notifications for urgent issues.
Cost-Effective Management: Approve and supervise expenditures under $250, offering detailed justifications and seeking Owner approval for expenses exceeding $250, ensuring cost transparency and fiscal responsibility.
Financial Transparency and Accountability
Transparent Billing: Clearly define all management fees and potential additional charges in a detailed fee schedule attached to this contract.
Expense Management: Maintain a rigorous protocol for expense reporting and approval to ensure budget adherence and avoid unexpected costs.
Communication and Reporting
Regular Updates: Establish a routine communication schedule with the Owner, including monthly financial reports and quarterly property performance reviews.
24/7 Availability: Ensure availability for emergency consultations and decision-making support around the clock.
Innovation and Continuous Improvement
Technology and Sustainability: Incorporate advanced property management technology and sustainable practices to enhance efficiency and property appeal, reducing operational costs and increasing tenant satisfaction.
Curb Appeal: Establish a routine communication schedule with the owner, including monthly curb appeal photos and property aesthetic reviews.
Risk Management
Liability and Insurance: Specify liability coverage and insurance requirements to protect both the Agent and the Owner from unforeseen damages and legal issues.
Dispute Resolution: Include a clear mechanism for resolving disputes, such as mediation or arbitration, to address any disagreements in a timely and fair manner.
Agent Service
New Property Management Account Set-up Fee: $250 - $500 for new property management account fee. This fee is intended to cover the Agent’s efforts in becoming familiar with the property, analysis for marketing the property, preparing the property for conducting showings, processing applications, and executing new lease agreements.
As Needed Repairs and Maintenance Fee:
Hourly Rate: $75 per hour for property management minor repairs and maintenance tasks directly managed by the Agent.
Service Invoice Fee: 10% of the total invoice for subcontracted repairs or renovations managed by the Agent, to compensate for coordination and oversight responsibilities.
Optional Add-on Landscaping Management Fee: This optional service ensures the property’s exterior is well-maintained and presentable throughout the year. The landscaping management service includes routine lawn care, trimming, and seasonal upkeep, while the snow removal service provides timely clearing of driveways, walkways, and other critical areas to maintain safety and accessibility. Fees for these services are determined based on the property’s specific requirements and the frequency of maintenance. This offering provides property owners with peace of mind, ensuring consistent curb appeal and tenant satisfaction regardless of the season.
Optional Add-on Additional Preparation for Leasing Fee: $75 - $750 cleaning fee. This fee is applicable only once per tenant turnover and covers deep cleaning and necessary preparations to make the Property suitable for new tenants. $75 hourly fee applies unless otherwise waived by mutual agreement if minimal cleaning is required.
Optional Add-on Advanced Real Estate Marketing Technology Integration Fee: $__TBD___ per day for local marketing activities. This fee covers additional costs of advertising the property through local media channels, online listings, and promotional materials to ensure high visibility among potential tenants. The daily fee is applicable only during active marketing periods preceding tenant placement.
Optional Add-on Staging Fee: $1,000 - $3,500, dependent on the square footage of the Property. This fee covers the cost of furnishing and decorating the Property to enhance its appeal during showings, with the exact fee determined by the total square footage being staged.
Optional Add-on Photography Fee: $500. This fee covers professional photography services for the Property, ensuring high-quality images for marketing and advertising purposes.
Optional Add-on Vacant & Second Home Services: $50 per day. This fee covers house sitting services, which include regular checks on the property, ensuring all systems are functioning properly, maintaining the premises in a clean and presentable state, and handling any emergencies or unexpected issues that may arise. This service is ideal for maintaining the security and upkeep of the property during extended periods of vacancy.
Optional Add-on Pet Sitting Services: $50 per day. This fee covers pet sitting services provided directly at the property. The service includes feeding, walking, and general care of pets in the comfort of their home environment. This fee ensures that pets are well cared for in the owner's absence, reducing stress for the animals and providing peace of mind for the property owner.
Additional Provisions:
Optional Add-on Legal Compliance Fee: This fee covers the additional workload of legal compliance services
Optional Add-on Eviction Fee: $1500 for each eviction process. This fee covers the additional workload and legal complexities associated with evicting tenants, including paperwork, court appearances, and coordination with legal services.
Cap on Hourly Charges: To ensure fairness, hourly charges for any single maintenance or repair incident will be capped at $150 unless prior approval from the Owner is obtained.
Clarification of Fee Application: The hourly rate applies to tasks estimated to take less than 2 hours. The percentage fee applies to larger projects requiring extensive management or coordination.
Repairs & Maintenance: The Owner hereby gives power to the Agent to supervise repairs, improvements, maintenance, alterations, and decorations to the Property as well as purchase and pay bills for services and supplies. The Agent shall obtain prior approval of the Owner for all expenditures over $100 for any single item. Prior approval for lesser amounts shall not be required for monthly or recurring operating charges or if emergency expenditures over the maximum are, in the Agent’s opinion, needed to protect the Property from damage, prevent injury to persons, avoid suspension of necessary services, avoid penalties or fines, or suspension of services to tenants required by a lease or rental agreement or by law, including, but not limited to, maintaining the Property in a condition fit for human habitation as required by applicable law.
HOMEOWNERS ASSOCIATION (HOA) COMPLIANCE
HOA Compliance:
Compliance with HOA Guidelines: The Agent is responsible for obtaining and maintaining a current copy of the Homeowners Association’s rules and regulations (the "HOA Documents") for each Property governed by an HOA. The Agent must review these documents to understand and adhere to all conditions and restrictions set forth by the HOA.
Owner Obligations: The Owner shall provide the Agent with all necessary documentation and information regarding the HOA, including contact details for the HOA management, at the commencement of this Agreement. The Owner is responsible for any HOA fees and assessments unless otherwise agreed upon.
Communication with HOA:
Liaison Role: The Agent shall act as the primary liaison between the HOA and the Owner. This includes attending necessary HOA meetings, relaying relevant information to the Owner, and ensuring that the Owner is aware of any changes or updates in the HOA policies that may affect the Property.
Reporting Requirements: The Agent shall promptly inform the Owner of any notices received from the HOA, especially those pertaining to potential violations, assessments, or amendments to community rules.
Compliance Actions and Violations:
Handling of Violations: If the Property is found to be in violation of HOA rules, the Agent is responsible for informing the Owner of the violation and coordinating efforts to resolve the issue promptly. This includes arranging for necessary repairs or adjustments to the Property to ensure compliance.
Financial Responsibilities: Costs incurred to address HOA violations will be initially paid by the Agent and reimbursed by the Owner, unless such costs are due to tenant negligence or damage, in which case they will be recovered from the tenant’s security deposit or through other means as provided by law.
Modifications and Improvements:
Approval Process: Any modifications, improvements, or alterations to the Property that require HOA approval must be submitted by the Agent, with plans or proposals provided by the Owner. The Agent shall ensure that all such activities are approved by the HOA before commencement.
Compliance with HOA Aesthetic Standards: All modifications and improvements will adhere to the aesthetic standards and guidelines set by the HOA to maintain property value and community uniformity.
Fees and Assessments:
HOA Fees: The Agent is responsible for ensuring that all HOA fees and assessments are paid on time if this responsibility is delegated by the Owner. The Agent shall provide the Owner with copies of all payment confirmations and receipts.
Budget Review: The Agent shall review the HOA's annual budget, if available, to forecast potential changes in fees or assessments that may impact the financial planning for the Property.
Emergency Procedures:
Emergency Contact and Protocols: The Agent shall maintain updated emergency contact information for the HOA and shall follow all established emergency protocols as required by the HOA, ensuring tenant safety and property integrity.
SECURITY DEPOSITS
The Agent is authorized to collect security deposits up to the maximum amount permitted by law, which will be held in a separate account as required by Idaho state law.
TERMINATION
This Agreement may be terminated by either Party upon providing thirty (30) days’ written notice to the other Party.
MISCELLANEOUS
Notices: All notices under this Agreement must be in writing and delivered via certified mail or in person.
Governing Law: This Agreement shall be governed by and construed in accordance with the laws of the state of Idaho.
Entire Agreement: This document represents the entire agreement between the Parties.
